In case number CRTR11-1837 the first witness to take the stand was Officer Black. Where he explained to the jury the use of Breathalyzer's for CHP officers in the field to use to determine a persons alcohol level and content.
Officer Black, on the stand demonstrated how CHP officers in the field administer the Breathalyzer. Which was a technical explanation bringing it down to a layman's understanding on how it works. As the DA for this case Quin continued to question the CHP officer on the stand by further examinations of how an officer out in the field used and applies the breathalyzer.
The defence Attorney for Alex Ms. O'Connor had very few rebuttal questions for the CHP officer, with this being the first witness on the stand in this case "People vs. Petroson."
DA Quin then entered the People's first Exhibit and it was accepted by the Judge and so marked as People's Exhibit 1, against the defendant Alex. Siskiyou County's DA Quin then went on with the Jury instructions for the calibrations of the Breathalyser and that were explained by Officer Black of the CHP. The arrest of Alex took place on May 3, 2012 on Hwy 97 as Alex was heading from Klamath Falls to San Francisco where Alex and his wife live.
When Ms. O'Connor had no further questions of the CHP officer Black. The Judge then asked the jury to write down any questions they have to be handed to the Bailiff to be then presented to the judge and the court of both sides to try and answer the jury's questions within the rules of law for the court and the judge to rule on.
