Tulelake, CA— “Brady list”
The last few city council meetings have been filled with the usual suspects and supporters of Tony Ross, the Chief of Police who is now once again an at-will employee, which means he can be terminated by a vote of the majority of council members at any time.
After an extensive review by the California Attorney Generals Office according to Siskiyou County District Attorney Kirk Andrus the GA’s Office declined to file charges because by the time it reached his office no review was done. Plus the case was being investigated as a misdemeanor and the statutes of limitations had expired.
As a result of the case Ross has been added to what is called “Brady List”, which is a list of potential witnesses whose honesty has been called into question that must be provided if the officer testifies in a court case. Which there is one presently pending and due to go to trial unless a deal is made not to go to trial by the DA Kirk Andrus and the defendant in the case before the court presently. According to a reliable source Ross is also on the “Brady List” in an adjacent county.
There is also an Administrative Claim that has been made against the City of Tulelake and the Chief of Police for violations of the Brown Act pending the response from the City Attorney of Tulelake and soon the entire new City Council.
Ross is upset by the changes and feels it is a decrease in pay as Ross has stretched out the situation while claiming he needed a one-year contract that would suffice from his point of view to resolve the lack of police protection under a one-year contract while waiting for a new officer to come on board. Which would end up costing the city more than what the city has decided to do in place of a one-year contract that Ross is upset over, along with his usual family and supporters of Tony Ross.
