Tulelake, CA— There is no agenda policy
The city of Tulelake does not have an agenda policy for what happens at city council meetings such as the following:
4. Public Participation
4.1 Public Forum During Public Forum any person may address the Council on an item that is (1) within the subject matter jurisdiction of the Council and (2) not otherwise on the agenda, except that if a speaker will not be present during an agenda item later in the calendar for that meeting, the speaker may address that agenda item during Public Forum but not later.
4.2 Addressing the Council Each person addressing the Council shall step to the lectern and announce if s/he is a resident or not. Providing a name and address is voluntary. All remarks shall be directed to the Mayor and Council as a body and not to any particular Council member. No person other than members of the Council and the person having the floor shall be permitted to enter into the discussion. No question shall be asked of Council members except through the Mayor.
4.3 Speech Content Statements by a member of the public shall be related to the agenda item at hand, except during Public Forum. Derogatory and discriminatory remarks relating to gender, sexual orientation, race or ethnicity, creed, religion, national origin, disability, and personal physical characteristics or conditions, slander, obscenities, and knowing falsehoods are irrelevant per se. If such remarks or other irrelevant statements substantially disrupt or disturb the peace and order of a City Council meeting they will be deemed cause for removal of the speaker from the meeting, as provided in sections 4.4 and 4.5 of these Rules. The City Council shall not prohibit lawful public criticism of the policies, procedures, programs and services of the City or the acts or omissions of the City Council.
4.4 Disruptive Conduct Conduct, including applauding and booing, which substantially disrupts or disturbs the peace and order of a City Council meeting is prohibited and is cause for removal at the request of the Mayor. On instructions by the Mayor, a police officer may be called for the purpose of removing any person who, in the Mayor's judgment, has violated the rules of conduct or otherwise disrupted the meeting. If a meeting is willfully interrupted by one or more persons so as to frustrate the orderly conduct of the meeting and the orderly conduct cannot be restored by removing the group or the person, the Council may, by majority vote, order the meeting cleared of members of the public and then continue in session with members of the press remaining present, unless they also participated in the disturbance. In addition, or in the alternative, the City Council may, by majority vote, declare a recess until order is restored.
4.5 Warning and Arrest If arrest by a police officer is necessary to restore order, the presiding officer shall give a warning and describe the offending conduct in substantially the following manner: “Your conduct (describe the offending conduct specifically) is disrupting this meeting and the public’s business. Your conduct is a violation of Penal Code section 403. You must stop immediately. If you do not stop, I will direct the police officer to place you under arrest.”
4.6 Written Communications The public may submit written comments to the Council through the City Clerk or City Manager's office and request that Council receive copies in the agenda packet, provided such written comments are received in sufficient time to include them in the agenda packet and multiple copies of voluminous documents are provided. Copies shall be made available to the public on request during regular office hours.
4.7 Time Limits Public comment shall generally be limited to 3 minutes per individual speaker per agenda item, except that the Mayor, with the concurrence of the City Council, may set a different time limit based upon the number of persons wishing to speak, the complexity of the item, the length of the agenda, the hour, and other factors.
There is also no city policy of investigating the Chief of Police for misconduct.
