ISSUE BEFORE COUNCIL: Should the Council adopt an ordinance banning tobacco use in City-Owned Parks, Marinas, Cemeteries, and Natural Areas?
SUMMARY AND BACKGROUND:
In March 2018, representatives from Healthy Klamath and Blue Zones approached the City about prohibiting smoking and tobacco use in City-Owned Parks, Marinas, Cemeteries, and Natural Areas. They had previously presented the idea to the Parks Board, where a recommendation was made to bring the request before Council. As part of the presentation, they provided a sample ordinance. Council directed staff to work with the Ordinance and adjust it to accomplish the goal. City Staff altered the proposed Ordinance to remove a provision in the sample ordinance prohibiting smoking or tobacco use within 10 feet of the boundary of any City-Owned Parks, Marinas, Cemeteries, and Natural Areas. Staff believed it would be inappropriate to regulate those activities on properties that are not owned or controlled by the City and recommended that the provision should be stricken.
The Ordinance, with that change, is similar to the one previously presented to the Parks Board and City Council.
