Tulelake City Council Approves sale of Tulelake Airport to the Modoc Tribe of Oklahoma

Who was here first for the Sale of Tulelake airport

Klamath Falls, OR— Sale of the land under the Tulelake Airport to the Modoc Tribe of Oklahoma was unanimously approved by the Tulelake City Council.

The location was changed from the City of Tulelake City Hall to the Tulelake Volunteer Fire Dept; due to the size of the crowd. Which, was somewhere between 70 or 80 people who gathered and showed up for the meeting on Tuesday evening July 31, 2018, for the Tulelake City Council meeting.

The city council coming out of the closed session, where Mayor Hank Ebinger started explaining the negotiations and to where no action was taken on the negotiations at this time from the special meeting at 4:15 PM.

Then at the regular city council meeting once it was moved and first to speak was Taylor Tupper of Klamath Falls, OR. She explained her native heritage and who all she was related to and the history back when the tribes were disbanded and the OR Modoc became the OK Modoc and that they are all cousins and she was related to and the history back when the tribes were disbanded and the OR Modoc became the OK Modoc and that they are all cousins and she expressed her concern that this negotiation was made without the OR Modoc being informed or invited.

Then the representative from the Japanese organization the Tule Lake Committee expressed how the organization had invested and given money to the National Park Service, and the US government over the years.

The Tulelake City lawyer explained how all this came about many years ago between the US government and the City of Tulelake. He also explained that the US government stipulated that this parcel must be used for an airport and for nothing else. Modoc Tribe of Oklahoma, in the paperwork, states that this parcel will stay an airport. The US government also stipulates that if this parcel is not used as an airport, it will revert back to the US government.

The underlying land cannot be sold as a profit. It must be sold at what it is valued at, so the value is $17,500. And the $17,500 amounts to lawyers fees, and anything above that would be considered profit and the US government would receive those funds, even if it was just one cent over the $17,500. The Tulelake City lawyer explained that if the City of Tulelake were to accept a higher bid, then the transaction would be null and void. Then the parcel would revert back to the US government. So, the Japanese's offer of $40,000 could not be accepted for those reasons alone.

Even though the Japanese offered $40,000, it is not about the money. It is about the rules, regulations, protocol, and the contract and the patient deed signed by Harry Truman on December 21, 1951. So the Modoc Tribe of Oklahoma with the lawyers and County of Modoc and the US government did all they were supposed to do.

The representative of the Modoc Tribe of Oklahoma laid out exactly the regulations, and laws pertaining to the sale of the Tulelake Airport. It was explained that this was their homeland and that the Modoc Tribe of Oklahoma was not there in a spiteful way. Modoc Tribe of Oklahoma just feels that with the purchase price of $17,500, the airport could make the renovations that it needed. One thing that is needed is a longer runway. If the runway were made longer it could then be used by the public. Modoc Tribe of Oklahoma has been in negotiations with the US government, County of Modoc and the City of Tulelake for quite some time now. Modoc Tribe of Oklahoma wanted everything precise and above board.

Other local citizens, along with Macy's Flying Service mentioned how happy they were with this sale to the Modoc Tribe of Oklahoma and that it would be beneficial to the community as a whole in the long run. Others not so happy for obvious reasons.
