KLAMATH FALLS, OR— City of Klamath Falls want to establish a downtown residential parking fee second public hearing and liquor license for new businesses. Along with CONSIDERATION OF LAND USE APPLICATIONS and AN ORDINANCE ADDING SECTION 5.250 TO THE CITY OF KLAMATH FALLS CODE

GENERAL PUBLIC HEARING

ISSUE BEFORE COUNCIL: Should the City Council establish a Downtown Residential Parking Permit, per section 1.075 set parking fees via the City Manager Fee Schedule, and impose downtown parking fees by the calendar year?

The Parking District was created, at the request of downtown business owners, to provide parking for buildings that did not have adequate parking for the use. Many of our older buildings were not built with onsite parking and publicly owned lots allowed them to have higher intensity uses than they could accommodate without the parking. The district is an attempt to get the users or those who directly benefit to pay for the service. With increased discussion around residential uses in the downtown, it seems appropriate to share some of the costs of maintaining the parking with those who would use the parking. The ordinance makes several changes to streamline permitting and establishes a residential permit for those desiring to park overnight in a City owned parking lot.

GENERAL PUBLIC HEARING continued but no one got up to speak this time. Downtown Residential Parking Permit, per section 1.075 to set parking fees via the City Manager Fee Schedule, and impose downtown parking fees by the calendar year was approved and passed. It will now be up to the City Manager Nathan Cherpeski to set the parking fees and come back to the council for approval in the near future.

COUNCIL Approved amending sections 7.145, 7.160, 7.165(2), 7.187, and 7.188 of City Code. Provide direction to the City Manager on the initial fee that should be charged.

                              

GENERAL PUBLIC HEARING-FULL ON-PREMISES SALES LIQUOR LICENSE REQUEST FOR DAVID'S BREAKFAST AND STEAK HOUSE LOCATED AT 2065 OREGON AVENUE

Lucio Cabrera, in conjunction with David’s Breakfast and Steak House is applying for a new outlet Liquor License to allow Full On-Premises sales at their restaurant establishment located at 2065 Oregon Avenue. This would allow the sale of distilled spirits, malt beverages, wine, and cider for consumption at the licensed business.

This new restaurant opened in November, 2018 at the former Waffle Hut restaurant location. Waffle Hut previously operated with a Limited On-Premises Sales License. The business location is zoned Neighborhood Commercial and the operation of a retail outlet is consistent with the zoning. The business will be open daily from 7 a.m. until 9 p.m.

COUNCIL Moved to recommend to OLCC the approval of Full On-Premises liquor sales for David's Breakfast and Steak House. GENERAL PUBLIC HEARING-LIMITED OFF-PREMISES SALES LIQUOR LICENSE REQUEST FOR DOLLAR GENERAL LOCATED AT 3810 GREENSPRINGS DRIVE

DG Retail, LLC, doing business as Dollar General is applying for a New Outlet Liquor License to allow Off-Premises sales at a newly opened retail location at 3810 Greensprings Drive. This would allow the sale of malt beverages, wine, and cider to go in sealed containers.

The new Dollar General retail outlet opened in December, 2018 and is located at the southeast corner of the Greensprings Drive and Agate Street intersection within the Stewart Lenox neighborhood. The business location is zoned General Commercial and the operation of a retail outlet is consistent with the zoning. The business will be open daily from 8 a.m. until 10 p.m.

COUNCIL Moved to recommend to OLCC the approval of Limited Off-Premises liquor sales for Dollar General.

LAND USE PUBLIC HEARING - QUASI JUDICIAL CONSIDERATION OF LAND USE APPLICATIONS 12-DESIGN REVIEW-18 AND 3-CONDITIONAL USE PERMIT-18

ISSUE BEFORE COUNCIL: Whether to approve Land Use Applications 12-Design Review-18 and 3-Conditional Use Permit-18 and allow for the construction of a government office building within the Timbermill Shores subdivision.

COUNCIL OPTION(S): Hold a public hearing and take testimony; and do one of the options listed below:

1. Approve with modified Applicant’s findings: Motion to accept the Findings and Final Decision recommended by staff (Exhibit 1) and approve Design Review 12-DR-18 and Conditional Use Permit 3-CUP-18 to construct an approximately 92,000 square foot three-story office building with the Oregon Department of Human Services (DHS) as primary tenant on Lots 10, 12 and 13 of Tract 1430-TimberMill Shores, subject to the conditions listed within the Findings and Final Decision document

2. Approve with modified findings: Motion to approve modified findings and/or conditions of approval as defined by Council (list modifications). Based on the approved findings; Motion to approve Design Review 12-DR-18 and Conditional Use Permit 3-CUP-18 to construct an approximately 92,000 square foot three-story office building with the Oregon Department of Human Services (DHS) as primary tenant on Lots 10, 12 and 13 of Tract 1430-Timbermill Shores, subject to the conditions listed within the Findings and Final Decision document (Exhibit 1).

3. Option to Deny: Motion to direct staff to modify findings to support denial of Design Review 12-DR-18 and Conditional Use Permit 3-CUP-18 based on direction from the Council. Motion to deny Design Review 12-DR-18 and Conditional Use Permit 3-CUP-18 to construct an approximately 92,000 square foot three-story office building with the Oregon Department of Human Services (DHS) as primary tenant on Lots 10, 12 and 13 of Tract 1430-TimberMill Shores, based on the modified findings.

Design Review and Conditional Use Permit Application Government Office Building

The Klamath Falls City Council Monday night approved the conditional use permit for the TimberMill Shores development to allow for siting a new Department of Human Services building on the property that abuts Lake Ewauna.

It was a three-to-one-vote in favor of the permit, with one councilwoman recusing herself from the hearing due to a last-minute conflict.
