TimberMill Shores, Oregon’s newest mixed use community, consists of approximately 50 acres. Phase 1 lies adjacent to the now vibrant downtown, the newer Klamath County Court House and the remodeled Klamath County Library. SELECTION MEMORANDUM: The competitive bid process began in June of 2017 and lasted over seven months. During that time, the State engaged in negotiations with five proposers and ultimately selected the site located at TimberMill Shores in downtown Klamath Falls. The State of Oregon will lease a newly constructed building from Klamath Falls Holdings on a long-term basis to house several DHS programs.

The Department of Human Services (DHS) offices in Klamath Falls are looking to move, though not where some originally had anticipated. State officials announced Friday it may relocate to TimberMill Shores, owned by Klamath Falls Holdings and Rubicon Investments. It would be the future site for what is described as a “Multi-Service Center” for local DHS offices. The center would be built at lots 12 and 13 of the 50-acre TimberMill Shores development, which sits along Lake Ewauna in downtown Klamath Falls.

It was announced February 26th that the future home of the regional Department of Human Services (DHS) office would be located at TimberMill Shores.
The Department of Administrative Services (DAS) represents State agencies in securing and negotiating bids from private developers. In this case, the State was seeking land for a large office building to consolidate DHS employees. Among other criteria the State considers, the State specifically asked for a location within the central business district or downtown Klamath Falls. The bids are submitted, by private developers or contractors, to the DAS who handles the bidding process and negotiations for State agencies.
In this case, the State only leases space within the building and does not own the building nor the land. The DAS first outlines criteria for what they are seeking and then publicly announces the project, and sets forth a deadline for submittals. Then DAS secures any, and all, bids from private contractors and developers, and then proceeds through a very long process with the officials from the State analyzing each submittal. In the case of this DHS building proposal, the individual sites were submitted and each site was ranked.
The DAS looks at criteria one of which such as location. TimberMill is centrally located within the Central Business District (which was a request of the State). Timbermill is also located adjacent to the courthouse, bus transit, and within walking distance to restaurants for the convenience of its employees and customers. TimberMill Shores was ranked highest amongst all the applications and therefore was awarded the bid. Klamath Works overall score was sixth out of nine sites.

Oregon’s Department of Human Services (DHS) and Department of Administrative Services (DAS) say that request for information processes were the public’s best bet for more comments on where to put future DHS office sites in Klamath Falls.
Community leaders in Klamath Falls continue to discuss the next steps of a new DHS services center set for the TimberMill Shores development. Many hoped that 1940 S. Sixth Street, a portion of the new Klamath Works Campus, would be the top choice.
Site evaluations from the state later show that the Klamath Works location scored sixth out of nine sites evaluated. No public meetings, commission meetings or town halls outside of the first RFI were planned to discuss the decision, though this does not seem to be outlined as a requirement on a state level.
News of Construction at TimberMill Sparks Other Interest March 28th, 2018
Rubicon Investments acquired a government office lease contract from the State of Oregon, and it seems to have sparked new interest in the TimberMill Shores development. Rob Shaw, Managing Partner for TimberMill Shores, said that a new prospect for a movie theater has recently come to light.
The idea came from Paul Stewart, CEO of Sky Lake Medical Center. Paul’s idea suggests that it would be in the best interest of the community, and Timber Mill Shores if a movie theater was built at the prime commercial location.
This would not compete with the existing movie theater. Rather, the idea is to repurpose the existing movie theater into a health education facility. Sky Lakes would purchase the existing theater and remodel it to meet their needs.
The proposed idea comes from Paul Stewart, in hopes that the movie theater can be exchanged for the new Department of Human Resource (DHS) office.
“The State has signed a lease for the DHS office at TimberMill Shores. After reviewing Paul Stewart’s offer, we believe that the proposal and site we put forward is the best location for DHS and the clients they serve. We understand that the state has communicated this same sentiment to Mr. Stewart yesterday, after we signed the lease. Vision for TimberMill Shores is Moving Forward
TimberMill Shores has seen significant activity in recent weeks. With the news that Rubicon Investments signed a long-term lease with the State Oregon for the Department of Human Services. There is renewed interest in the mixed-use campus. Rubicon’s plans go far beyond the DHS Multi-Service Center. As of Friday, April 6, 2018, Rubicon closed on five additional lots within the development.
Rubicon Has No Intentions of Moving from TimberMill Shores
Paul Stewart, CEO of Sky Lakes Medical Center has previously suggested that Rubicon was entertaining the idea of moving their new building, and respective DHS lease to the Klamath Works Campus.
There is a process in place for the State to negotiate real estate and lease contracts, however the window for negotiation ended once the award was made on February 27, 2018.
Rubicon has communicated to Mr. Stewart that they are not interested in his proposal. The proposed “land swap” that Stewart continues to promote ignores the duty that DHS and DAS have to act in the taxpayers’ best interest.
It is disappointing to see that Mr. Stewart and Sky Lakes are continuing their objections to the selection process for the DHS Multi-Service Center. However, Rubicon and TimberMill Shores have made numerous efforts to let Paul Stewart know that this offer would not be contemplated, by either party.
The State sent Mr. Stewart a letter to clarify the process and inform him that their decision is final. As Mr. Stewart continues to misrepresent the interest of Rubicon Investments, a Cease and Desist letter was sent to Paul Stewart and the Sky Lakes Medical Center Board, to indicate that true position of Rubicon Investments.

KLAMATH FALLS – Noting it is their civic obligation and moral responsibility, Sky Lakes Medical Center board members are seeking a judicial declaration that the State of Oregon failed to follow the law in selecting Timbermill Shores as the proposed site of a new social services building.
The Oregon Human Services and Administrative Services departments in the spring decided to contract with Rubicon Investments, of Corvallis and Medford, to construct a social services building on Timbermill Shores along Lake Ewauna. State law requires that, prior to making that decision, the state must make a finding that doing so was consistent with local zoning and planning. The civil suit filed today in Klamath County Circuit Court by Sky Lakes alleges that did not occur.

Research: Social services not an economic stimulus
Research indicates that social services typically do not stimulate economic development in the neighborhood where they are located. Economist Andrew Biggs cites research from the Urban Land Institute finding that planners should avoid locating social services in areas where they hope to stimulate retail development. Its not true that any development is better than no development, Biggs said. That's why we have zoning laws to ensure that neighborhood enterprises are compatible and work together for both social and economic development.
Businesses and individuals in the downtown corridor indicated they overwhelmingly oppose siting a social services building at Timbermill Shores.
“The Klamath Falls Downtown Association has not adopted a formal position regarding this project,” said Darin Rutledge, Executive Director of the Association, “but a recent informal poll of the downtown community showed that nearly 78 percent of those responding are opposed to locating the social services at Timbermill Shores.”

Petitioner Sky Lakes Medical Center, Inc. is a community-owned, internationally accredited acute-care teaching hospital serving the people of Oregon’s Klamath and Lake Counties and California’s Siskiyou and Modoc Counties. Petitioner is an Oregon non-profit corporation with its principal place of business located in Klamath County at 2865 Daggett St, Klamath Falls, OR 97601.
2. Respondents Oregon Department of Human Services (“DHS”) and Oregon Department of Administrative Services (“DAS”) are agencies of the State of Oregon.
3. On March 27, 2018, DHS entered a lease and buildout agreement with Klamath Falls Holdings, LLC, which provides for the lease and construction of a DHS facility at TimberMill Shores, Lots 12 & 13, Klamath Falls, Oregon 97603. DHS intends to use this facility, at least in part, for the provision of social services to the public.
