Judge takes case under advisement in Criminal Trespass II, as City of Klamath Falls Police Department is being sued in Federal Court by Tulelake News

On Monday the Judge, Judge Dan Bunch in case number 19CR45438 , as the Defendant James Garland appeared for Criminal Trespass II at 10 AM on Monday September 9th, 2019, with all the motions filed at this point, by the defendant James Charles Garland in Pro-Si, in this case before the court at the Klamath County Courthouse.

With the latest update being as follows:

        

         

Where during the Hearing-Pre-Trial Judge Dan Bunch called Mr. Garland's name. And as Mr. Garland was approaching the defense table Judge Dan Bunch said the following: (Mr. Garland approached the defense table and began to put his brief case on the table.)

"Mr. Garland first of all I would like to apologize for how long it has taken me to make a ruling, and there is no need to unpack your brief case, as you will not be here long. I promise you by the end of the week, I will have a ruling on all your motions." There was a bit of cross talk back and forth between the Deputy DA, Ben S. Lykins and Judge Dan Bunch, over motions filed.

As Mr. Garland sat on the prosecution side of the Court room, the Bench Bullies of 203 Main Street sat on the defense side of the court room, huddled together. Starting with the Managing Agent Lake Park Towers Apartments Melod McGeeM, Resident Manager Everett Clyde Long Lake Park Towers Apartments and one of the tenants best friend from 203 Main Street, Klamath Falls OR, from the Lake Park Towers Apartments.

Where they assumed they could speak to the judge about the situation at 203 Main Street, Klamath Falls at the Lake Park Towers Apartments from their point of view without Mr. Garland, the defendant representing himself in Pro-Si being given notice by the Deputy DA Ben Lykins that they were going to speak to the judge.

As soon as Judge Dan Bunch, made his comments, the defendant left the court room swiftly, to get as far away from the Bench Bullies of 203 Main Street, to avoid any confrontation, or contact with them, and get out of the courthouse, as quickly as possible, away from the Bench Bullies from 203 Main Street, KLAMATH FALLS, OR.

Now it is just a waiting game, as the case is now off calendar waiting for the ruling in the mail from Judge Dan Bunch, within the week, as to rather this case will be dismissed or set for trial and a future date rescheduled.

In the meantime, the City of Klamath Falls City Attorney Michael Swanson has been verbally notified, that the defendant Mr. Garland is planning on filing a civil suit in Federal Court against Linda M. Bogatay Owner of Building, and the Klamath Falls Police Department. Where the City Attorney Michael Swanson had "No Comment", on this matter during the discussion with the defendant James Garland in Pro-Si and the City of Klamath Falls City Attorney Michael Swanson on Wednesday of this past week at his office at the Klamath Falls City Hall.
