Question of Electability for Dave Henslee

Dave Henslee Acknowledges the lawsuit against him and the city of Klamath Falls for alleged racial bias in police work and opponent Allan Headley cites the Oregon Constitution Section 2, Article 11, which defines what makes candidates ineligible for accepting office.

There seems to be a conflict and a past legal situation as to rather Dave Henslee running for Commissioner Position 1 is eligible to take office, if he wins with this legal binding situation still not having been resolved yet.

According to Dave Henslee and his answers to questions at several forum events on video links and Dave Henslee's own comments from Candidate for Klamath County Commissioner Facebook Page in his own words as follows:

"During my campaign, an opponent has decided to create a story for the internet and pose as legitimate news site. He claims I may not be able to serve as your county commissioner because of an article in the Oregon Constitution.

This is completely false and I was able to address this fake news story posted on this fake news site for the first time today during a Rotary forum.

My opponent has been noticed that I believe he is violating the law (ORS 260.532 / False Publication Related to a Candidate). He has yet to remedy the situation." https://www.facebook.com/electdavehenslee/

Audience questions began with an opportunity for a response.

Dave Henslee's opinion is that "they", his opponents created fake news stories by following up on a citizen's question asking if he knew he MAY not be eligible to hold another office of public trust again while a pending $11.75 million-dollar federal lawsuit involving allegations of 14th amendment violations is unresolved, unsettled, and the liabilities for the city, police department, and individual defendants are fully accounted for. Henslee asserted that nothing in the Oregon Constitution (especially Article II, Section 11) which is about "corporations???" stands in his way of being sworn into another office of public trust.

The Oregon Constitution, Article II, Section 11 is titled Suffrage and Elections, It reads "No person who may be hereafter be a collector, or holder of public moneys, shall be eligible to any office of trust or profit, until he shall have accounted for, and paid over according to law, all sums for which he MAY be liable." The office of County Commissioner holds public trust and they are stewards of public moneys.

Candidate Henslee's random and puzzling statement that Article II, Section 11 is actually about "corporations begs for immediate clarification, given the word "corporations" isn't mentioned once in Article II, Section 11. The Oregon Secretary of State, County Election Clerk or Attorney General maybe be called on to issue a clarifying "statement of fact" to enlighten the confused public and opposing candidates. ORS 30.285
