City of Klamath Falls fails to check with the NEPA before approving jet in Vets Park


New Location for Jet in Vets Park by ZCS Engineering and Architecture

"ISSUE BEFORE COUNCIL: Should the City execute design Contract Amendment #2 in the amount of $21,450 plus an additional contingency allowance of $2,150 with ZCS Engineering and Architecture to prepare another set of plans showing the F-15 static display on the other side of George Nurse Way on the existing concrete stage area?"

"SUMMARY AND BACKGROUND: On June 21, 2022, Council authorized the City Manager to execute a design services contract with ZCS Engineering and Architecture (ZCS) to design an F-15 Static Display in Veterans Park. The location within the park was adjacent to the lake and adjacent to the existing boat house. Over the past year, there has been substantial input on the location of the display. With this in mind, staff took another look and believes this revised location closer to the actual memorial is a workable compromise. The existing stage or amphitheater area isn't heavily used, but future events would have the jet as a backdrop and also provide some level of shade. A walkway would link the memorial to the Jet." (City Council passes 5.2)

At the city council meeting there were quite a few people in the public comments section of the agenda making comments; both pro and con, for or against the jet in Vets Park, or approving the new location by the item on the agenda, at tonight's city council meeting.

At tonight's meeting one person mentioned and asked if the city had approval yet from the (NEPA) National Environmental Policy Act. The National Environmental Policy Act (NEPA) was signed into law on January 1, 1970.

NEPA requires federal agencies to assess the environmental effects of their proposed actions prior to making decisions. The range of actions covered by NEPA is broad and includes:
*making decisions on permit applications,
*adopting federal land management actions, and
*constructing highways and other publicly-owned facilities.
Using the NEPA process, agencies evaluate the environmental and related social and economic effects of their proposed actions. Agencies also provide opportunities for public review and comment on those evaluations.

Title I of NEPA contains a Declaration of National Environmental Policy. This policy requires the federal government to use all practicable means to create and maintain conditions under which man and nature can exist in productive harmony.
