Can the Tulelake Airport be sold according to the PATENT AGREEMENT signed by President Harry S. Truman?
Klamath Falls, OR— There are some documents that were signed and approved by President Harry S Truman the 21st day December, 1951.
The question comes to mind for all concerned parties according to page 5. Where it states "The City of Tulelake, State of California, does by the acceptance of this patent covenant and agree for itself, and its successors in function, forever, as follows: (Now read for yourself 1-6 on page 5 of the above documents.)
Which, to my understanding means that whoever buys the property buys it as an airport. Which, it seems the Modoc Tribe is willing to adhere to that agreement. But, does that mean the Tule Lake Community is willing to do the same and abide by the FAA requirements and construct fences as required or are they just trying to make a larger offer to avoid ever constructing fences just as an excuse to buy the Tulelake Airport with that purpose in mind to never construct the fences as a ploy? And by doing so according the Patent Agreement in numbers 4-6. would be in violation of the Patent Agreement signed by President Harry S Truman?
Otherwise, in the event of a breach of any condition or covenant the Federal Government may immediately enter and possess himself of title to the herein-conveyed lands for and on behalf of the United States of America.
And 6., continues to allow the United States Government to take full charge of the Tulelake Airport, with no if's or and's or but's about it, according to the Patent Agreement signed and dated by President Harry S. Truman on the 21st day December, 1951.
It surely will be interesting as to the next Agenda coming out of the Tulelake City Council on Tuesday, July 31, 2018 @5:30 PM for the City Council Meeting in the Tulelake City Hall Council Chambers. Located at 591 Main Street, Tulelake, CA., 96134.
