KLAMATH FALLS, OR— What Are Civil Rights?
The term "human rights" refers to rights that are considered universal to humanity regardless of citizenship, residency status, ethnicity, gender or other considerations.
Civil rights are a set of rights—established by law—that protect the freedoms of individuals from being wrongly denied or limited by governments, social organizations, or other private individuals.
Civil Rights vs. Civil Liberties
Civil rights are often confused with civil liberties, which are the freedoms guaranteed to the citizens or residents of a country by an overriding legal covenant, like the U.S. Bill of Rights, and interpreted by the courts and lawmakers. The First Amendment’s right to free speech is an example of a civil liberty.
The following motions have been filed with the court for the August 5th hearing and pre-trial. Where during the hearing as the honorable Judge Dan Bunch ruled to take the motions under consideration with a ruling to come shortly by mail. Where the Deputy District Attorney Ben S. Lykins OSB #164303 was not in attendance at the August 5th hearing and Pre-trial set for that day, nor has the Deputy District Attorney Ben S. Lykins OSB #164303 responded to the last two motions filed with the court on August 5th, 2019.
MEMORANDUM IN SUPORT OF MOTION TO DISMISS
Burden of proof: The Plaintiff has the burden of production to come forward with facts demonstrating a prima facie case of the existence of said property line in order for the defendant to be charged legally with a citation of 2017 ORS 164.245¹ Criminal trespass in the second degree.
In the process defendants' time has been delayed in continuing to edit news videos that were put on hold to deal with the legal issues before the court. The court has delayed defendants legal defense according to the 14th Amendment by three weeks now waiting for a ruling from the court as to denying or dismissing the motions filed with the court as of August 5th, 2019.
With the next hearing pre-trial set for September 9th, 2019 at 10:00 AM. Which could be grounds for appeal after trial for defendant in the court of appeals, as well as in the US Supreme Court, as this case ends up there in the future for a SCOTUS RULING over the merits in this case by all parties in 19CR45438 before the court and listed on the docket and court calendar set for September 9th, 2019 at 10:00 AM.
